Terms

The conditions an order runs under. Written to be read, because a term nobody understands protects nobody.

1. Who you are dealing with

This site is operated by FLOFUM, S.L., a company registered in Spain, with its office at Calle Parcerisa 13, Local 1, 08014 Barcelona, tax identification CIF B75621250. Syphrix is a trading name of that company. Contact is support@syphrix.com.

2. What the site is

A catalogue and a way to ask what something costs. It is not a shop that can take payment: there is no basket, no checkout and no mechanism anywhere for entering card details. Prices shown are indicative and confirmed to you in writing before anything is dispatched.

3. When a contract exists

Sending an enquiry is not an order and binds neither side. Our reply quoting a figure is an offer. A contract forms when you accept that figure in writing, and not before.

We may decline an enquiry — stock has gone, the address is outside the area we serve, or the order is not one we can fulfil sensibly. Declining costs you nothing.

4. Prices

The figure quoted is the total: goods, Spanish VAT and delivery, with nothing added afterwards. It holds for seven days from the date of the reply. After that we re-quote, because supplier prices move.

Where a listed price is obviously wrong — a decimal in the wrong place — we are not obliged to honour it, and we will tell you before anything is dispatched rather than after.

5. Payment

Cash to the courier on delivery, in the currency of the delivery country. No other method is available, and no deposit is taken at any stage. Nothing is owed until the box is physically with you.

6. Delivery

Included in the quoted figure, to street addresses in the EU. Timings on the delivery page are working-day estimates given in good faith, not guarantees, and a carrier delay is not a breach of this contract. Risk in the goods passes to you when you accept and pay for the box at the door.

7. Cancelling and returning

You may cancel free of charge at any point before dispatch, and you may refuse the box at the door for any reason at no cost. After delivery you have thirty days to send something back, which is longer than the fourteen days required by EU distance-selling rules. Terms are on the returns page.

8. Guarantee

Every item carries the two-year statutory guarantee of conformity under Spanish and EU law. Detail on the guarantee page. Nothing in these terms reduces your rights as a consumer.

9. Descriptions

We describe what we sell as accurately as we can, including capacities, dimensions and materials. Photography is representative; a natural material such as wood varies between pieces, and a difference in grain or shade is not a fault.

10. Our liability

We are responsible for loss you suffer as a foreseeable result of our breaking this contract or failing to use reasonable care. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

We are not liable for loss arising from an item being used for something it was not made for, or contrary to the instructions supplied with it.

11. Law and disputes

Spanish law governs these terms, and the courts of Barcelona have jurisdiction, without affecting your right as a consumer to bring proceedings where you live. The European Commission’s online dispute resolution platform is at ec.europa.eu/consumers/odr, though writing to us first is usually faster.

12. Changes

These terms may change. The version that applies to your order is the one published when you accepted the figure, and we keep the earlier versions on file for that reason.
